Enrollment

As a public school system, we welcome all students who live within the district's boundaries and meet state age and health requirements. For specific enrollment information, please contact your child's school. If you need to verify that you live within the BHSD38 boundaries, please use the School Finder to look up the boundaries for your address. 

  • All familes are required to prove residency upon registration.  Legally, we cannot allow students who do not reside within our District boundaries attend our schools without paying tuition. Please review the school policy (7:60).

    In case you have questions regarding legal requirements for residency verification within a school district, please review the information below:

    • The residence of a person who has legal custody* of a student is the student’s residence.
    • The parent with the majority of parenting time is considered to have legal custody.
    • Residency is:
      • Physical presence (at least half of time must be spent at the residence)
      • Intent to remain
      • Presence is not for the sole purpose of attending school in the district

    Legal Custody means one of the following:

    • Natural or adoptive parent with whom student lives
    • Custody by Court order for reasons other than access to the school district
    • Statutory Short-term guardianship, provided that within 60 days a court order establishes permanent guardianship and grants custody for purposes other than access to school district
    • Adult caretaker relative receiving public aid for student living with adult for purposes other than access to the school district
    • Custody exercised by adult who demonstrates that he or she has assumed and exercises legal responsibility for the student and provides the student with a regular fixed nighttime abode for purposes other than access to school district.

    Requirements for Short Term Guardianship:

    • Biological or adoptive parent whose parental rights have not been terminated may appoint short term guardian for child in writing without court approval.
    • Cannot appoint short term guardian if child has another living parent whose rights have not been terminated, whose location is known and who is willing and able to make and carry out daily child-care decisions, unless that parent consents in writing to the appointment.
    • Appointment indicates when the guardianship becomes effective and ends. Appointment may last for up to 365 days and be renewed for another 365 days (but note for school residency lasts only 60 days).
    • Must be signed by appointing parent, guardian being appointed, other consenting parent and two adult witnesses

     

    Requirements with registration:

    Mortgage paperwork Vehicle registration
    Signed and dated lease AND proof of last month’s payment Voter registration
    Letter from manager AND proof of last month’s payment Most recent utility bill (cable, gas, electric, water, etc)
    Current bank statement

  • The McKinney-Vento Homeless Assistance Act 


    The McKinney-Vento Act is a federal law guaranteeing all children and youth the right to an equal education, regardless of their living situation. Protection under the McKinney-Vento Act extends to those who lack a fixed, regular, and adequate nighttime residence.

    The Education for Homeless Children and Youth program, which is part of the McKinney-Vento Homeless Assistance Act, ensures that eligible children have the following rights: 

    • Choice of school: Children eligible for McKinney-Vento services may attend their school of origin (school last attended or school attended when a child lost permanent housing) or attend the school that serves their temporary living situation (choice of caregiver) 
    • Immediate enrollment: Even if medical or other records, birth certificates, or transcripts cannot be produced at the time of enrollment 
    • Transportation: Transportation must be provided if requested 
    • Preschool: Priority consideration to preschool programs for eligible youngsters 
    • Free lunch & fee waivers: Categorically eligible for free lunch 
    • Supplemental tutoring: If needed
